外教上崗須有資質身份介紹

隨著我國對外開放的深入發(fā)展和綜合國力的不斷增強,來華就業(yè)的外國人數(shù)量也隨之增加,尤其是在外語教學方面,許多學校、幼兒園和培訓機構為了提高教學質量、增加吸引力,聘用了許多外教老師。

然而,外國人在我國境內(nèi)教授外語,首先應當遵守我國法律規(guī)定,依照相關程序、取得相應資格。根據(jù)《中華人民共和國出境入境管理法》和《外國人在中國就業(yè)管理規(guī)定》的規(guī)定,外國人在中國就業(yè),必須先由用人單位代外國人向人力資源和社會保障局、外國專家局等主管部門申請《中華人民共和國就業(yè)許可證書》,獲準后由用人單位將簽證通知函和《中華人民共和國外國人就業(yè)許可證書》寄達外國人。

外國人持簽證通知函和該證書向我駐外使、領館申請職業(yè)簽證。入境后,須申請獲得《外國人就業(yè)證》和外國人居留許可,方可在中國就業(yè)。否則,就是違法就業(yè),公安部門將對其進行處罰。

在本期江蘇省南京市玄武區(qū)人民法院審理的案件中,某培訓中心宣傳的“外教來自美國、英國等英語為母語的國家”與事實不符,且提供英語教學服務的外教也不符合法律規(guī)定的在我國就業(yè)的條件。因此,法院認定該培訓中心存在虛假宣傳,其向原告提供教育培訓服務具有欺詐性,應依照合同法和消費者權益保護法對原告進行雙倍賠償。

盡管外教在語言教學中對母語發(fā)音可能更加標準,但學生及其家長也不能對此盲目迷信,應當保持理智,搞清外教的真實身份、水平和資質。同時,用人單位也應當遵守相關法律和誠信原則,以免偷雞不成蝕把米,最終害人又害己。
